BENIN, August 05, (THEWILL) - The Edo State governorship election of 14th July 2012 was fraught with fraud, irregularities, rigging and manipulations, and the only way to deepen democracy and the rule of law in the overall interest of the people of the state is to contest the results at the election petition tribunal, the People’s Democratic Party (PDP) has said.

Gen. Charles Airhiavbere, the party’s candidate in the election, had filed a petition at the tribunal last Thursday, challenging the victory of Governor Adams Oshiomole of the Action Congress of Nigeria (ACN).

According to Josephine Aliyu, secretary of the tribunal, Airhiavbere filed the petition through Sunday Agwinede and four other counsels.

The first and second petitioners, Airhiavbere and the PDP, are challenging Oshiomhole, and five others — ACN, Independent National Electoral Commission (INEC), Edo Resident Electoral Commissioner (REC) and the State Governorship Returning Officer.

They claimed that the “purported election” was invalid due to corrupt practices and non-compliance with the provisions of Electoral Act 2010 (as Amended), and also alleged intimidation and harassment of voters, claiming it deprived them of exercising their franchise and constitutional rights in 11 local government areas of the state.

On Sunday, PDP also added that Oshiomhole was invalidly returned by the REC despite that the election was not conducted in compliance with the provisions of the electoral Act 2012 (as amended).

“The returning officer … wrongly proceeded to declare Adams Oshiomhole winner of the election by issuing form EC8E on the 15th day of July, 2012. The Resident Electoral Commissioner (Edo State) also subsequently and wrongfully issued Adams Oshiomhole with the certificate of return on behalf of the Independent National Commission (INEC),” read a statement by the Edo State chapter of PDP, signed by director of publicity, Okharedia Ihimekpen.

“Adams Oshiomhole, who was purportedly returned as the winner of the said election, was not qualified to contest for the said election for the office of the Governor Edo State. Furthermore, despite the non-revision and non-amendment of the voters register, amended and criminally altered voters’ register were used in various wards and polling units in the three senatorial districts.”

In addition, PDP is contesting the academic qualifications of Oshiomhole, accusing him of only tendering a modern school leaving certificate without a primary school certificate, which by the constitution does not qualify him to contest the election. Even the modern school certificate he presented on oat to INEC, it further claimed, had been found to be fake.
