Land Dispute: Drama In Court Over Plaintiff’s Indecision

A mild drama ensued yesterday at a Chief Magistrate Court sitting in Ilesa, Osun State when a plaintiff, Emmanuel Olaniyi Fadeyi, who had earlier sought for the order of the court to withdraw the suit he filed against an Ilesa High Chief, Chief Matthew Oyekanmi Ogedengbe (62) suddenly changed his mind to continue with the case.

Fadeyi had dragged Ogedengbe to the court on a three count charge of stealing, breach of peace and unlawful destruction of his building foundation located at stadium area, Oke-Ibukun, Ilesa.

When the case came up yesterday for mention, Fadeyi through his counsel, Olusayo Ajewole told the court that his client is no longer interested in withdrawing the charge against High Chief Ogedengbe.  No reason was given for the withdrawal letter which had already been placed before the Chief Magistrate M.A. Lasisi.

The police prosecutor, Corporal Jimoh Mufutau told the court yesterday that the complainant brought a letter of withdrawal of the case and later told him on phone that he is no longer interested in withdrawing the charge against the accused person.

He stated that the offence was committed on April 2012 and contrary to and punishable under section 81 and 451 of the criminal code Cap 34 Volume II laws of Osun State of Nigeria 2003.

Counsel to the accused person, Boye Willams explained to the court that the parties had agreed to settle out of court and that the letter of withdrawal is already before the court, praying the court to encourage amicable settlement of the matter.

But the Counsel to the complainant, Olusayo Ajewole objected to the claim saying that his client is no longer withdrawing the charge against the accused person.

According to him, “it was true that the complainant wanted to withdraw the case against the accused person but he is no more interested in withdrawing the case”.

Delivering his ruling, the Chief Magistrate, Lasisi adjourned the case till Wednesday 22nd August 2012 for hearing.
