July 4 has been set by the National Industrial Court for hearing in the suit filed by the former CBN Governor, Malam Sanusi Lamido, challenging his suspension by President Goodluck Jonathan.
Justice Gabriel Kolawole of the Federal High Court, Abuja, had in May declined taking the case on the grounds that the court lacked jurisdiction to handle it.
Kolawale had held that the plaintiff’s suit was a matter within the purview and exclusive jurisdiction of the President of the National Industrial Court as it was a labour matter between employer and employee.
The Judge also struck out the name of the Inspector-General of Police from the suit as prayed by his counsel, Mr Solomon Umoh, SAN.
Kolawole then transferred the case to the National Industrial Court for determination.
Sanusi, in the originating summons, had urged the court to restrain the defendants from “obstructing, disturbing, stopping or preventing him in any manner whatsoever, from performing his functions as Governor of the Central Bank’’.
However, at the mention of the case on Friday, Sanusi’s counsel, Kola Awodein (SAN), asked for adjournment to enable him consult with his client in view of his recent elevation to the position of the Emir of Kano .
The Lead Counsel to the Attorney General, Mr Mike Ozekhome (SAN) did not object to the application.
Justice Babatunde Adejumo, adjourned the case as prayed. [NAN]
