The Assemblyman for Abuakwa in the Atwima Nwabiagya District of the Ashanti Region who allegedly took advantage of the desperation of a trader and defrauded him has been arraigned before the Nkawie Circuit Court.

Michael Amoah Awuku, the Assemblyman, was charged with defrauding by false pretense contrary to section 131 of Act 29/30 of the criminal code when he appeared before the court, a charge of which he pleaded not guilty.

Information which was presented before the court had it that the accused informed Isaac Acheampong, the complainant, that he could give him a strategic point to erect his container to sell his mobile phones and accessories.

Since the complainant had been affected by the relocation of market men and women to pave way for the reconstruction of the Abuakwa market he believed the accused could help him since he was the assemblyman.

However, after haven paid GH¢900, being part of GH¢1500 charged by Mr. Awuku to give him a place, he could not secure the place for the complainant as agreed since he is not the custodian of the land.
The complainant, according to police reports, embarked on his private investigation from the traditional council and the district assembly gathered that the place shown him by the accused was not even a place to erect a temporary structure.

Isaac Acheampong consequently reported to the police and the accused was arrested and cautioned to that effect. The prosecutor said that the accused in his own handwriting admitted that he collected the said amount from the complainant and finished his statement pleading that “I will require a period of two weeks to refund the money.”

Unable to fulfill his own statement at the given time, the assemblyman was arraigned before the court where he pleaded not guilty to the charge. The court presided over by Justice Noble Nkrumah granted him bail to the tune of GH¢1000 with one surety to reappear on September 2, 2010.
