The suspects were said to have committed the crime on June 5, 2011 at about 9.30 pm in Ikorodu, Lagos State.
The charge sheet read, “Jimoh, Shobowale and Kanson and others at large, including Kamarudeen Lamina and 23 others, on the said date, unlawfully killed Awelorun by shooting him in the eyes and all over his body with a gun.”
The three accused were charged on two counts of conspiracy to commit felony and murder, an offence said to have run foul of Sections 516 and 319 (1) of the Criminal Code Laws of Lagos State, 2003.
According to an application for remand filed by the police under Section 236 (6) of the Criminal Procedure Law, Cap 18, Vol II, Laws of Lagos State, 2003, it was stated that “the accused were reported at the State Criminal Investigation Department, Panti, Lagos, for armed robbery, murder, treason, illegal dealing in petroleum product and tampering with oil pipeline.”
The police requested in the application that, since it appeared that the issue of jurisdiction would affect the trial of the case at the court, the magistrate, Mr. M.O. Olubi, should remand the suspects to enable the Directorate of Public Prosecutions to give its legal advice.
Olubi granted the application and remanded the suspects pending the DPP advice on the case.
The case was adjourned till June 21 for further hearing.
