24  Forum / Naijapals Base (Metro life) / Nigeria Files Lawsuit Against JP Morgan For $1.7 bn Oil Deal on: 23-02-2022 12:20 PM

A London court will on Wednesday begin to hear a lawsuit launched by Nigeria against U.S. bank JP Morgan Chase, claiming more than $1.7 billion for its role in a disputed 2011 oilfield deal.

The civil suit filed in the English courts in 2017 relates to the purchase by energy majors Shell and Eni of the offshore OPL 245 oilfield in Nigeria, which is also at the centre of ongoing legal action in Milan.

In the court documents seen by Reuters, Nigeria alleges JP Morgan was “grossly negligent” in its decision to transfer funds paid by the energy majors into an escrow account to a company controlled by the country’s former oil minister Dan Etete instead of into government coffers.

The damages sought include cash sent to Etete’s company Malabu Oil and Gas, around $875 million paid in three instalments, plus interest, taking the total to over $1.7 billion. The Nigerian government at the time asked JP Morgan to make these transfers as part of the oilfield sale, court documents show.

Quote
“J.P. Morgan is confident that it acted appropriately in making these payments, which were authorised by senior representatives of the Nigerian government, and only processed following extensive engagement with law enforcement and other agencies and courts. We will robustly defend against this claim,”
a spokesman for the bank said.

The bank’s London offices deal with business for Europe, Middle East and Africa, including Nigeria.

Etete’s lawyers did not immediately respond to requests for comment. Etete is not a party in this suit.

Shell and Eni are also not parties to the law suit at the London High Court. Shell declined to comment.

Eni said in an email: “Eni was finally acquitted following the trial in Milan since there was no case, so we have nothing to add with regards to the OPL 245 deal and to the London trial, which doesn’t involve Eni.”

The London case dates back to 1998 when Nigerian military ruler Sani Abacha awarded the offshore oilfield licence, OPL 245, to a company Etete owned.

The $20 million price tag – of which Etete paid about $2 million, according to court documents – was widely viewed by industry experts as too low given the block was expected to yield billions of dollars of crude, although it remains undeveloped.

Subsequent Nigerian administrations contested Etete’s rights to the field, triggering years of legal wrangling until a deal designed to end the battles was struck in 2011.

Etete’s company Malabu Oil and Gas handed the undeveloped OPL 245 back to Nigeria as part of a resolution agreement involving Shell and Eni.

To complete the deal, Shell and Eni paid a signature bonus of about $200 million directly to the Nigerian government and then deposited $1.1 billion in the Nigerian government’s escrow account with JP Morgan, court documents show.

In the related Italian case in Milan, Shell, Eni and its executives were on trial from 2018 to 2021. Italian prosecutors alleged the companies paid $1.1 billion in bribes to Nigerian officials and others through the OPL 245 deal.

A panel of judges acquitted the companies and executives, who all denied any wrongdoing, last March. Prosecutors have appealed the ruling. read more

A spokesman for the Nigerian government said the London case would hold JP Morgan to account.

Quote
“JP Morgan was on clear notice that the payments put its customer, the Federal Republic of Nigeria, at risk of being defrauded which was what, indeed, happened,”
he said.

26  Forum / Naijapals Base (Metro life) / My Entitlements Haven't Been Paid For Refusing To Join APC - Female Ebonyi Lawmaker Reveals on: 23-02-2022 11:28 AM

female lawmaker, Ngozi Eziulo has alleged maltreatment by the Ebonyi State House of Assembly over her refusal to dump the Peoples Democratic Party to join the ruling All Progressives Congress, according to SaharaReporters.

Eziulo, a member representing Afikpo North East State Constituency said she has been denied her entitlements since she refused to join the APC after the governor defected, News Wire reports.

'The female lawmaker denounced letters that were read on the floor of the House, stating that she defected to the APC and resigned as a member of the House.

On Monday, the Speaker of the Ebonyi State House of Assembly, Francis Nwifuru read a letter alleging that the female lawmaker had resigned her membership of the House and defected to the APC.

But speaking to journalists in Abakaliki, Eziulo said she never wrote such documents, describing the so-called resignation as false.

Quote
“I never wrote the letter and can never write such letter. I am still wondering how they came about such a letter. That letter is a forgery. If they said I have resigned, let them bring such a letter let me see it with my signature.

“I am considering legal action because that letter is forged and you know forgery is a criminal offence,”
she said.

The lawmaker said she had no reason to leave the PDP, which she said had been good to her.

She was absent during the plenary when the said letters were read on her behalf on the floor of the House.

Eziulo also alleged that she had not been paid her salary and other entitlements since Governor David Umahi defected to the APC from the PDP, and she refused to also defect.

Quote
“Ever since the Governor defected, I have not been paid my entitlement including salary. When I asked, they said their reason is that I have not joined them in APC, that once I join, they will start paying. I told them if that is the condition, I will never join and they are still holding on to it,”
she said.

She noted that despite a series of letters and reminders written by her lawyers to the House for her entitlements to be paid, the House has vehemently refused to pay her.

According to her, her life is being threatened by those who are hell-bent on forcing her to join the APC.

“My lawyer has written them twice asking them to pay my entitlements but they have refused. In fact, they have threatened to take my official car. They have also been threatening my life, by saying they will send their thugs after me all because I refused to join them,” she alleged.

The lawmaker said despite not being paid her entitlements, she has always attended sittings and other functions of the House of Assembly.

She vowed not to leave the PDP, saying,
Quote
“I don’t see any reason why I should leave my party PDP. This is a party that brought me to the House. I am somebody that will ever remain grateful to people that do me good. PDP did me well so I can’t leave the party.

“I have people that voted me into power. I didn’t vote myself into power. So, I can’t just leave without their permission and approval. When the issue of defecting to the APC came up, I asked for time to consult with my constituents and stakeholders who gave me the mandate.

“I consulted them and they told me to remain in PDP, so I remained in PDP. I have a love for my people and they have a love for me. So, if they said I wrote such a letter, I am saying to you here right now that I didn’t write such, it is fake. If they said I wrote and submitted it yesterday, I was in Abuja, so how is that possible?”

She added that the House may be plotting to suspend her from the House very soon.

She said,
Quote
“I have been quiet in the house but that doesn’t mean I am weak. They should not take my quietness for weakness. I know after this; they will likely suspend me. I won’t be surprised if they do that. They have already planned to suspend me but I am not bothered. I have God and He will fight for me. Justice will always prevail in the long run.

“Since they stopped my salary and entitlements, I have been surviving because God has been providing for me through my stakeholders and party leaders who have stood by me.

“And that is the reason why I said I can’t leave the party because I have a lot of support from them. Even without being paid my salary and other entitlements, I have been attending plenary and my other legislative duties. I came to the House to provide quality Leadership to my people not for any financial gain. So, I have not allowed the nonpayment of my entitlements to affect my legislative duties.”

29  Forum / Naijapals Base (Metro life) / Unmarried Female Police Officers Shouldn’t Get Pregnant - Court Rules on: 22-02-2022 01:36 PM

A federal high court in Abuja has dismissed a suit by the Nigerian Bar Association (NBA) seeking to invalidate some provisions in the Nigeria Police Force Regulations (NPFR) which forbid unmarried female police officers from getting pregnant.

The Regulation provides that
Quote
“an unmarried woman police officer, who becomes pregnant, shall be discharged from the Force and shall not be re-enlisted except with the approval of the Inspector General of Police”.

Citing the instance of Omolola Olajide, a female police officer who was fired on January 26, 2021, in Ekiti state for becoming pregnant while unmarried, NBA said such discriminatory regulations have made many female officers childless for fear of being fired.

Quote
“The male police officers and married female police officers in the Nigeria Police Force are not subjected to similar discrimination, sanction, opprobrium and indignity,” the association said.

“There are many unmarried female police officers in the NPF who, because of this discriminatory practice, cannot have or be allowed to have children because of fear of dismissal from the Police Force.

“Married female police officers are allowed to be pregnant and have children while still serving in the Police Force; they also enjoy maternity benefits.”

President Muhammadu Buhari has moved to stop the mass migration of Nigerian youth as he laments that the trend is ‘draining Africa’s talent pool’.

The president who spoke in Brussels, Belgium, at the 6th EU-AFRICA summit, is seeking partnership with European countries to stop the trend.

In the article published in Politico, an online/offline magazine which is the most influential publication for the EU/ in Brussels, President Buhari said despite its best efforts, Europe will not find a sustainable remedy to this problem by further reinforcing its Fortress Europe approach.

However, despite burgeoning possibility, irregular northward migration from my continent drains Africa’s talent pool, while provoking political cr!ses in the EU. Despite its best efforts, Europe will not find a sustainable remedy to this problem by further reinforcing its Fortress Europe approach.

Instead, more opportunities must be created for Africans at home, providing alternatives to the decision to take a life-thre#tening boat journey in order to seek them elsewhere. The relationship between the EU and Africa must be rebalanced to power job creation. Unfortunately, today’s arrangements do just the opposite.”

39  Forum / Naijapals Base (Metro life) / Reno Omokri Shares Tips On How To Overcome Poverty. on: 21-02-2022 11:47 AM

Former Aide to Ex-President Goodluck Ebele Jonathan, Reno Omokri has shared some tips on how to overcome poverty.

Pinpointing at the neighborhood of an individual, Reno Omokri deduced that where one lives affects opportunities available to him/her.

the former aide advised people to move from a low rent area even if they have to live in a room in a high rent area.

According to him, poverty is not caused by generational curses, but by generational bad habits triggered by one’s environment.

On Twitter, he wrote: “Where you live affects opportunities available to you. By living in a high rent district, you will be aware of more job or business opportunities than those in a low rent district. Your proximity to opportunity gives you an edge over those living in a low rent area.

Quote
“Your neighbourhood affects your wealth perspective. If you live in a low rent area and get $1000, you may feel you’ve arrived, because you are better than others. But in a high rent area, you realise $1000 is nothing, and that challenges you to improve your earning.

“Better to be an average guy in a high rent area than be a lord in a ghetto. Move from a low rent area even if you have to live in a room in a high rent area. Poverty is not caused by generational curses, but by generational bad habits triggered by your environment.

“You are the average of the 5 people you hang around with the most. Your neighbours either add to your labour or your favour. That is why you should choose where you live wisely. Slums often come with scums. It is hard to rise above your location.”

40  Forum / The Buzz Central / Rapper, MI Abaga Reveals Reasons Why Nigerian Youth Ventures Into Cyber Crime & Ritual Killings on: 21-02-2022 11:16 AM

Nigerian Rapper and Record Producer, Jude Lemfani Abaga popularly known as MI has revealed why many youths now engage in fraud and ritual killing.

According to the rapper, the unemployment rate is one of the causes.

Reacting to why some Nigerian youths have decided to engage in Yahoo-yahoo, ritual killings and other heinous crimes instead of engaging in legal businesses, Abaga retorted that the situation was as result of the youths’ inability to secure jobs.

Quote
“The youths of Nigeria have been looking for jobs. For anyone to make a claim that they are lazy, the person must be able to look at the indices. You can’t just make that sort of conjecture without having the economic framework within which that’s true.

“You can’t say youths are lazy and don’t want to work if unemployment is high. The unemployment rate tells you that there are no jobs. If you look at the job market, you will see that there has been serious gross unemployment for a long time. Anytime that there’s gross unemployment, there’s also a tendency for there to be high crime rate, which is what we are experiencing.

“But the high crime rate is not the indication of young people’s attitudes. It’s an indication that there is an ecosystem where there is no opportunity for them to work.

“And, because they can’t work, and they have to eat, that’s why they have to find a means to survive. That is what we are experiencing in Nigeria today,” he stated.

However, Abaga advised the youths to take advantage of the opportunities provided by information technology.

He called for greater collaboration between “creatives and the tech space”, saying, “I think the creatives are sort of left as the unserious people of the society. What we want to show today is that creatives make everything better. They run the tech space.”
