4  Forum / Naijapals Base (Metro life) / Supreme Court orders lawyer to pay N8m fine to Delta state governor on: 26-05-2014 11:47 PM

The Supreme Court today Monday May 26th ordered Dr Dickson Osuala to pay N8million fine to Governor Emmanuel Uduaghan of Delta and 3 others for abuse of court process, PM News reports.
Osuala was counsel to Chief Great Ogboru, candidate of the Democratic People’s Party in the 2011 Delta governorship election. Other parties in the N8 million cost are the PDP, INEC, and the Attorney General of the Federation (AGF) who are to get N2million each.
Osuala‎ had, on behalf of his client, applied for a review of the court’s judgement which in 2013 upheld the election of Uduaghan of the PDP. He had claimed in his application that, Section 285 (7) of the 1999 Constitution which the Supreme Court relied on to dismiss the case, was “fraudulently inserted by the National Assembly”.
He argued that due process was not followed by the National Assembly on the section.
The counsel, therefore, submitted that it was wrong for the apex court to have relied on it to dismiss his client’s case in 2013.

Delivering his ruling, Justice Walter Onoghen blamed Osuala for not advising his client rightly and embarking on a clear case of gross abuse of the court process.
“The said N8 million is awarded as cost against the person of Dr. Dickson Osuala and is to be paid from his pocket to the respondents.
“The plaintiff, through his counsel, wants to resurrect a dead and buried horse.
“The plaintiff’s counsel should advise his client to take his case to heaven if he is not satisfied with the court’s ruling,” he said.
Onoghen said it was not the business of the court to amend the constitution, but that of the national assembly.

He advised him to go to the National Assembly or the Federal High Court to challenge the section of the constitution which he considered defective.

Osuala rejected the advice, adding that nobody should be allowed to benefit from a defective law.
NAN reports that Ogboru had twice applied for a review of the judgement but the Supreme Court had turned down his prayer on both occasions.

The clergy man also told the court that his wife had overwhelmed his life with miseries.
"Oluyemisi exposed me to public ridicule when she tore my clothes, including my underwear, and compressed my testicles. I spent several weeks in the hospital and when I returned, she warned me not to receive visitors if I needed my life. She falsely accused me of having extra marital affair with my church secretary" Olumide said.
The plaintiff further told the court that his wife had ruined his ministry following her domineering attitude, adding that from more than 50 members, his congregation had dwindled to a handful.
"She does not even take care of domestic issues like preparing my food and that of the children anymore. I have to combine all that with evangelism when I should be resting. In fact, she has almost sniffed life out of me" Olumide said.
Oluyemisi, however, told the court that her husband and his family were always beating her.
"He had a wife before he married me, and they are still seeing each other till date. He even invites her to our night vigils. Olumide asked me not to work and yet, he does not take care of me" Oluyemisi said.
Ezekiel Ogundipe, the court's president told the couple to invite their relatives to court on the next adjourned date, and adjourned the case to June 9 for further hearing.

9  Forum / Naijapals Base (Metro life) / Breaking News: Nigerian Military Locates Abducted Schoolgirls on: 26-05-2014 09:47 PM
More than six weeks since over 276 schoolgirls were kidnapped the Boko Haram insurgents at the Government Girls Secondary School in Chibok, Borno State, the Nigerian military might have finally discovered where the girls are being kept.
The Punch online reports that the Chief of Defence Staff, Air Marshal Alex Badeh, has stated that the Nigerian security leadership has located where members of Boko Haram are holding the abducted girls who were kidnapped on April 14.

It was also stated that Badeh said the military would not use force to rescue the girls in order not to prevent the terrorists from killing them.
The military boss was said to have made this statements while receiving a solidarity rally organised by the Citizens Initiative for Security Awareness, led by its National Coordinator, Mr. Chidi Omeze, outside the Defence Headquarters, Abuja on Monday.

Badeh was quoted to have said that the Nigerian military had the capacity to bring back the abducted girls but are restrained because they do not want to use force.
He added that the military knew what it was doing and implored that Nigerians, and the world at large, should allow them to continue with their work.
Badeh opined that the military would not go and get the girls killed in desperation of bringing them back.

He said: “We want our girls back,; we want our girls back; we can do it, our military can do it but where they are held, can we go with force?

* Chief of Defence Staff, Badeh
“If we go with force, what will happen? (they will kill them). So nobody should come and say the Nigerian military does not know what it is doing. We know what we are doing, we can’t go and kill our girls in the name of trying to get them back. So we are working.
“The good news for the girls is that we know where they are but we cannot tell you, we cannot come and tell you military secrets here. Just leave us alone, we are working, we would get the girls back.”
When asked by newsmen on what he meant that the military would not use force to release the abducted girls, Badeh was silent.
On recovery of arms and ammunition by the military in various parts of the country, the CDS said the arms are alien to the Armed Forces.
He said that some foreigners were supporting the insurgents, adding that the President had said there were Al-Qaeda in West Africa.
CISA Coordinator, Chidi Omeje, said they represented ordinary Nigerians on the street who realised that no nation can stand on its own without a strong military.
This latest discovery is coming after the Nigeria government has said it would not negotiate with the Boko Haram sect on the release of the schoolgirls.
The leader of the terror group, Abubakar Shekau had stated that he would only release the girls in exchange for 'his brethren' captured by the Nigerian military.
Since that declaration, the international communities which include the US, the UK, France, China and Canada have rallied round the Nigerian government to ensure that the kidnapped schoolgirls regain their freedon alive.
