The Kansas Supreme Court on Friday July 25th overturned the death sentences of two brothers convicted of killing four friends who were robbed and forced to have sex with each other before being shot to death and left in a snow-covered Wichita field.
The court also struck down three of the four capital murder convictions each against Jonathan Carr (pictured right) and Reginald Carr (pictured left), citing procedural problems at the brothers’ joint trial for its decisions. It upheld one capital murder conviction for each of them. Continue…

Prosecutors said the brothers broke into a Wichita home in December 2000 and forced the five people there to have sex with each other and later to withdraw money from ATMs. Two women were raped repeatedly before all five were taken to a soccer field and shot while they were kneeling. Four of them – 29-year-old Aaron Sander, 27-year-old Brad Heyka, 26-year-old Jason Befort and 25-year-old Heather Muller – died.

One of the women survived a gunshot wound to the head and she ran naked through the snow to seek help. She became a key witness at the brothers’ trial on the capital murder convictions.

The killings ended a series of crimes that authorities alleged the Carr brothers committed over nine days in December 2000.

The Kansas Supreme Court ruled 6-1 in overturning the Carr brothers’ death sentences because the presiding judge did not hold separate sentencing proceedings for each man.

In overturning most of their capital murder convictions, the majority said the instructions to jurors had been flawed because the judge tied those charges to the rape of the surviving victim, not the deceased ones.

The brothers’ cases will return to Sedgwick County District Court for further proceedings
Republican Gov. Sam Brownback and several GOP legislators were immediately critical of the decisions, which involved crimes that were among the most notorious in the state since the 1959 slayings of a western Kansas family that inspired the book In Cold Blood.

The legislators said the ruling shows the court’s unwillingness to uphold a death sentence, and the governor said he was stunned.
‘They were convicted by a jury of their peers in front of an elected local judge,’ Brownback said in a statement.
‘Today’s ruling unnecessarily reopens wounds of a tragic moment in Wichita’s history.’

Heyka’s father, Larry Heyka, also expressed disappointment and said he was struggling to make sense of the rulings, which totaled nearly 480 pages.
‘Hopefully going forward, we will all understand what these rulings really mean,’ said Heyka, who is from Council Grove.

Attorneys for the brothers did not return telephone messages seeking comment.
Sedgwick County District Attorney Marc Bennett said he’s not sure whether his office will appeal to the U.S. Supreme Court, but he promised to continue pursuing death sentences.
Jonathan Carr, now 34, and Reginald Carr, 36, were in their early 20s when the crimes occurred.

Together, they were convicted of 93 counts, including rape, aggravated kidnapping and aggravated robbery.

The state Supreme Court upheld a total of 57 convictions against them.
Most of the overturned convictions involved the allegations of forcing their victims to engage in sex acts.

He said: “I have warned them through my broadcast on Champions Television and I have tried to reach out to those I saw in my predic­tion.

“It is going to happen soon and nobody should blame anybody for it. It is either they retreat from that meeting they want to attend or they will perish.”

On the 2015 general elec­tions, Bro. Ignila said he saw the man presently on the seat at the Villa, still sitting com­fortably on the seat in 2015 and advised the ruling party to formulate policies that would pacify the opposition after a hard fight at the polls.

Arik Air on Sunday made known its intention to suspend flight operations into Liberia and Seirra Leone over the wake of deadly Ebola outbreak in both countries.

This is what Arik Air’s spokesman, Banji Ola said on the issue:

“Arik Air will be suspending operations into Monrovia (Li­beria) and Freetown (Sierra Leone) effective July 28, 2014 and the suspension will be in force until further notice.

“We are taking this impor­tant step as a concerned cor­porate organisation bearing the interest of Nigerians at heart and this decision is a pre-cau­tionary measure aimed at safe­guarding the precious lives of Nigerians.”

A Liberian who reportedly brought the deadly virus into Nigeria last week has died. Patrick Sawyer died at a medical facility in Obalende area of Lagos and since then, no Ebola infection has been reported.

Prevention they say is better than cure, kudos to Arik Airline.

Lagos Police Killed Yahoo Boy: Suspected Internet Fraudster Tortured To Death In Police Cell

This is the story of an easy going aluminum product dealer identified as Kazeem Oyolola who was said to have been tortured to death during an investigation by the police after his arrest at a beer parlour.

Read an eyewitness account of the story:

“I was sitting in front of my shop when the police van passed. They had initially come during the sanitation to pursue some traders away, but when they got here, we were already through with the exercise.

“Kazeem and his two friends were relaxing in the next shop. The policemen just asked them to come inside the van, and took them away. We did not know what they were arrested for. In the afternoon when we went to the station, we were not allowed to enter.

“At evening time, when I came back to check, I heard he had been taken to a nearby hospital, and that his condition was critical. By the next morning, we heard that Kazeem had died, while his two friends who received similar wounds had been released by the police to go and take care of themselves. The youth in the area staged a protest against the incident.”

A tenant at the deceased’s residence said:

When I got to the hospital, his parents had arrived to look after him. His hands and legs were swollen. His mouth was wide open and he could not talk. You could see several bleeding spots all over his body. I do not know what information the police received, but I can tell you that Kazeem is an easygoing man in this area. He is a trader who deals in Aluminium products, and he has a younger brother who stayed with him. He should not have died in this cruel way.”

It was learnt that the police had arrested Oyolola and his friends as suspected Internet fraudsters, otherwise known as Yahoo boys.

They were tortured in a bid to get them to confess to the crime but Oyinlola sustained life threatening injuries that eventually led to his death.

So sad! May God console his grieving parents.

“Invariably, this would have sparked up a corresponding reaction of violence from an equally militant antagonistic young population from across the Niger. One needs not be a political analyst to see that such a scenario might have culminated in the demise of our nation.”

“To win this war, we must embark forthwith on accurate diagnosis. There is a fundamental difference between traditional Islam and the radical Islam of our day. To lump them together would be a tragic mistake. It would only produce error, which would lead to attendant terror.

“I only hope that this is a wakeup call to our government and we must now rise up so that together we can deploy all our resources to stop the terrorists dead in their tracks,”

ABIA (NAN) ― The Police in Aba, Abia, has confirmed the death of a four-year-old boy after an all night prayer in a church on Saturday morning.

The police, who did not give the name of the deceased, also confirmed that 15 other persons were choked during the event.

A group called the “Young People’s Christian Fellowship, Ututu, Arochukwu’’, were reportedly made unconscious by fumes from a generating set used for the all night prayer meeting.

The police Area Commander, Aba, ACP Peter Wabara, made this known to newsmen in Aba.

“We got a phone call this morning that some persons were allegedly lying dead in a church at 8 Eziukwu road by Milverton Avenue, Aba.

“So I mobilised my men and called in some doctor friends since the government doctors were on strike and they accompanied us to the scene of the event.

“There we looked through the glass door and found them lying unconscious in a scattered manner. Fortunately, some of them were breathing so we moved them to two hospitals,” he said.

Wabara said that 11 of the worshippers were evacuated to Austin-Graces hospital on Okigwe road while four of them were moved to Goodness and Mercy hospital on Faulks road, Aba.

According to the commander, before leaving the scene, the rescue team searched the church environment and found a generating set that had exhausted its fuel and quenched but was still hot.

The commander said that there was a noxious odour in the air of the warehouse-turned-church which gave them the impression that the worshippers may have over-inhaled carbon monoxide.

He said that he accompanied the Deputy Governor of the state, Col. Emeka Ananaba (Rtd) to the hospitals and found that the persons involved were responding to treatment.

Wabara also said that the deputy governor had made a donation of an undisclosed sum of money.

The money was donated after a meeting with the Area Commander, the Commissioner for Health and an assistant medical director, at Abia State Teaching Hospital, Aba.

Some of the persons brought to Austin-Graces hospital had recovered and could recognise people, but were unable to field reporter’s enquiries during the visit.

Philip Richard, Senior Pastor, Word Alife Assembly, Aba, the Secretary of pastors from Arochukwu in Aba, told NAN that the worshippers were all indigenes of Ututu in Arochukwu local government area.

“I was not there but I had a phone call telling me this morning that the believers from Ututu in Arochukwu who went to pray in a church in Aba had all died.

“I left all that I was doing to get to the scene of the event. We have a fellowship of believers of Ututu origin in Aba and they came to pray for themselves and their community at this venue.

“I was not there. They are from various churches and not from one church. The husband and wife whose child died are from my own church,” he said.

Meanwhile, a police source who was among the rescuers, told NAN that the boy died as a result of the weight of his heavily-built father which fell on him when the man became unconscious.

The source said the child was seating beside his father and when they became unconscious, the father unknowingly fell to that side of his seat, pressing the boy and making breathing hard for him.

Another source from Ututu, told NAN on condition of anonymity that the man and his wife had lost one of their two children last month.

She said that they were left with only the boy that died at the prayer meeting on July 26.

Girl Blows Herself Up In Kano: Female Boko Haram Suicide Bomber Dies At North West University

A teenager hired by Boko Haram terrorists to cause mayhem at a university in Kano has died.

The young female suicide bomber estimated to be 16 years of age killed herself today at Northwest University, Kano State Government owned university located along Gwarzo Road off Kofar Kabuga.

According to Kano State Police Command, the teenager died around 1pm Nigerian time on Sunday. She was spotted walking suspiciously towards the school gate when police guarding the area spotted her, isolated her and called for reinforcement from female police officers adept at handling Muslim females.

The young woman who had a bomb concealed inside her hijab, killed herself by detonating her explosives, five policemen suffered minor injuries.

Emir of Kano State, Sanusi Lamido Sanusi has cancelled Eid festivities marking the end of the Muslim holy month of Ramadan next week after a deadly church bombing and a female suicide bomber’s attempt to attack a university, an official said Sunday.

A statement issued by the Emir reads:
“Given the critical situation we are in, the royal highness (of Kano state, Emir Sanusi Lamido Sanusi) has suspended all festivities associated with the eminence including the Durbar and other traditional events that are held during the Eid festival,” an aide to the emir, Aminu Ado Bayero, told AFP. -
