SMH : You can’t try us, subsidy suspects tell Lagos court

LAGOS — Two oil marketers, Samuel Bamidele Aro and Abiodun Bankole yesterday asked an Ikeja High court to wash its hands off the alleged N1.3 billion oil subsidy fraud charge levelled against them on the ground that the court lacks power to entertain the case.

In a preliminary objection filed by Chief Anthony Idigbe, SAN, on their behalf which was briefly argued before Justice Lateefa Okunnu, the marketers  challenged the ability of the Economic and Financial Crimes Commission, EFCC, to arraign them.

The marketers who were charged by the EFCC alongside their company, A.B.S Investment Company Limited said the charges were grossly defective.

However, counsel to EFCC, Mr. Rotimi Jacobs, SAN, who told the court to give him short date to file his response, prayed the court to discountenance the motion.

According to the defendants’ counsel, Idigbe, “The court does not have jurisdiction to entertain the charges. The entire charge is grossly defective and incurably bad since no fiat was obtained from the attorney general of Lagos State. The prosecution counsel have no competence to prosecute the defendants before this court.”

EFCC lawyer, Mr. Jacobs, SAN, said he was just being served with the process  and needed time to file his response.

Further hearing was adjourned to December 21 for mention.
