Governor Rotimi Amaechi of Rivers State has asked a Rivers State High Court, sitting in Port Harcourt, to restrain the Chief Judge of the state from constituting any panel to investigate any notice of allegation presented by the House of Assembly, except the request is in compliance with sub-sections 2, 3 and 4 of Section 188 of the 1999 Constitution, as amended. Counsel to Amaechi, Chief Lateef Fagbemi (SAN) in the suit, is praying the court to, among other things, set aside any attempt by less than 22 members out of the 32-member House to initiate an impeachment proceeding against him.

He is also praying for “an order of this court setting aside any notice of allegation to initiate the removal proceedings of the state Assembly, conducted in connection with the conceived removal from office of the claimant by less than 22 members out of the 32 members constituting the state Assembly.”

He is also asking the court to declare as unconstitutional, any proceedings for his removal that may be conducted outside the “Rivers State House of  Assembly/Parliament building situate on Moscow Road, Port Harcourt, Rivers State, which is the official address of the state Assembly for the conduct of the official and legislative duties of the House as unconstitutional, null and void and of no effect whatsoever

He is also asking for a declaration that any proceedings of the state House of Assembly, initiated by less than 11 member, which is one third of members of the House and passed or conducted by less than 21 out of the 30 members of the House, which is two third of the members of the House in connection or in relation to the commencement of impeachment proceedings against the claimant are unconstitutional, null and void and of no effect whatsoever.
Counsel to the five anti-Governor Amaechi lawmakers, Mr Emanuel Ukala (SAN) applied to be joined in the suit, but same was opposed by Mr. Olusola Dare, who represented Fagbemi ( SAN).

Trial judge, Justice George Omereji adjourned the matter till July 30, for hearing of the joinder application.  See more at: http://houseretailnews.blogspot.com

Bros,I beg to differ with you.But before I go on I want to tell you that you insulted the other guy Cellema, the Cellema of a guy also deserved your insult because he have already insulted another man (Governor Amaechi), by calling him an IDIOT which I am sure Governor Amaechi is not.Now having said this,I believe we are the youths of Nigeria,I believe our fathers in Nigeria from 1960 to date have failed us.I also believe it is within our powers the youths of Nigeria to either change the status quo and make our country better or to peaceably dissolve the country, whichever way,I just stand for the restoration of the dignity of the African man (woman).
Now coming back to the Governor Amaechi matter,I think Amaechi is very wrong on what he is doing,Governor Amaechi came to power in Rivers State because of the magnanimity of a law abiding President Ya ra Dua,of the party of PDP.I am a Nigerian,I do not like PDP,but President Ya ra Dua of PDP set a precedent in the non-charlatan Nigerian Judiciary,a precedent that cannot be overturned by anybody in either the Judiciary or the Presidency. What I am saying is just this.It is a simple matter,if Governor Rotimi Amaechi does not want to comply with the rules of the party that brought him to power,he should just resign from the party and join the other party. Those little northern governors inciting him are just playing the tune of the owner of the piper. You cannot be anti Party A,and still continue to enjoy the platform and privilege of party A.It has never been done in history.I am a Southerner. When the chicken gets home to roost,Governor Amaechi will realize that he is being used by those who think that the ruler-ship or dictatorship of Nigeria belongs to them. But we the youths,we are watching......
