Hi guys,
I was recently denied a UK visa by the british embassy for allegedly fraudulently obtaining an immigration stamp on my passport. The said passport has also been impounded. i'll summarize the main part of the story below
I had gotten into UK from another country(legal residence here), spent a couple of weeks, came down to nigeria, spent a month, went back to the UK spent a few days before returning to that country. These events happened over 2 yrs ago
However my refusal is based on the premise that i never made that trip to nigeria. that i had instead spent the entire time in the uk before that return trip to that country. It claims that the Nigerian entry immigration stamp as such was fraudulently obtained. They have therefore denied me visa on this basis and seized my passport as a result.
It should be noted i had been granted Visa after those trips by the UK embassy but was applying for a renewal.

Any ideas what to do next would be very helpful.

lets advise accordingly

The embassy will only investigate and return your passport to the NIS. Nigerian passport is the property of the Nigerian Government. If at the end of the day, the investigation proves that you have lied in any way. You will not be able to visit the UK for a minimum of 10 years.

Well, I can see the poster is hiding some truth in his story, the confidence is low and that only happens when you're lying, using statements like a went from a country (does the country have a name) to UK and went to another country, as a matter of fact the storyline sounds like that of a drug peddler, which ever way, I can assure you that you DID stamped your passport (illegally) without being to Nigeria, you might think it is impossible to know this because the person that helped to get it stamped might have given you full confidence and so on, but truth is you're caught and the earlier you start making alternative plans, the better for you because at this point I can assure you that you have been barred for 10 years and the passport will be sent to NIS in Abuja and if they have time, might send your details to EFCC in which case, the visa issue will only be the least of your worries.
OK, I didn't want to say this, but whatever, I might just spell it out for you anyway, people in your situation always come out clean at this point, but you are insisting that you indeed came to Nigeria and blah blah blah, I must tell you that you are not alone, there are hundreds of thousand of people that did same thing you did and the British consular is doing exact same thing to each and every case, you might think they are witches and wizards, but they are not, in-fact the way they find out is by cross checking your name on the IATA database (which they have access to, as far back as 1990's) - so simply put, if you claimed you travelled from UK to Nigeria on a certain date and arrived at the Lagos or Abuja airport but your name is not on the passenger's list for IATA for that day - then the only explanation is that you have traveled with a different name and used your own passport? (Already you can see your story cannot hold water in anycase), the IATA is the international agency responsible for air travel operations and their database was mainly for security purposes but since 2010 a new party has taken over the governance of UK and they are the right winged conservatives who believed in complete blocking of immigration and so on, Essentially they then slashed all aids they would normally give to Nigeria (stating grounds of intolerance of homosegxwality and so on as reasons why aid should not be sent to Nigeria) and have reinvested that same money to strengthen their immigration systems and employ thousands of heads that can co-reference your name to the IATA database and find out if you exactly flew that day or around the period you claimed to have travelled to Nigeria. I heard story of a very rich Nigerian too that was in similar situation, unfortunately he was also banned for 10 years but he couldn't be bothered. So, you do know the truth and I know you know what I am talking about, you can just ignore that for now and focus on other thing, the IATA holds an extensive database of all air passengers for so long, which before now was primarily for fighting terrorism but right now, its good to fight immigrants from 3rd world countries too, which is an abuse of privacy but, who can fight them.

That is why it is easy to track down terrorist activities and tell which countries he's being to in years past, all they need to put is your last name, nationality and DOB.

Good evening House,
I resides in the UK, In November 2014, my wife applied for a settlement visa to come and join me in the UK at the time of the application, I was very convinced that we met all the immigration requirement because I took my time to make sure all the necessary supporting evidences were enclosed as we have had 3 applications refused previously in 2011 (visitor visa), 2012 (Settlement visa) and 2013 (Visitor visa) for my graduation, this was just some month after our wedding which took in Nigeria. I know people will be wondering why we applied for a visitor visa but the reason was because I just graduated and was not earning up to £18600 (Minimum Income threshold). But was surprised and when the application was refused and my wife 2 international passport was retained, One is cancelled and a valid one. It is worth noting that prior to the application in 2011, she had already applied for a UK visa which was refused but that has no connection with me at all and as you are all aware in the UK visa application form they do ask for the where about of old passport but she said to me that the passport is lost, so in all the other applications that were made from the aforementioned year (2011) we let the British high commission know that the passport is lost.

What's more, the reasons for refusal are as follow;

(1) RETENTION OF NIGERIAN PASSPORT NO A05******/A02*****

The passport that you were intending to travel with, as detailed above, has been retained as we are not satisfied that the document satisfactorily establishes your identity and nationality, in view of the fact that you have previously applied for a UK visa using a different date of birth. Enquiries will be undertaken at this office and the document will be forwarded as soon as practically possible to the Nigerian Immigration Service in Abuja. The Nigerian Immigration Service will decide whether further action is required. In these cases, enquiries should be addressed to the address below:

Comptroller General, NIS
Document Fraud Unit
Nigerian Immigration Service HQ
ABUJA

yours sincerely

Entry Clearance Manager
UK Visas and Immigration

(2) "The applicant did not provide a letter from her sponsor's employer with her application which confirms the sponsor's employment status and salary. With this application a letter dated 24 September 2014 has been submitted. This carries the letter head of XYZABC123 (my employer) but appears to be a photocopy. The letter carries the writer's name "Miss xxxxx Bleep" But has no signature. Consequently no employment letter is considered to have been provided. The applicant has therefore not provided the document required by Appendix FM-SE paragraph 2 (b).

Facts

The first reason for refusal was not true because my wife said she never use any other date of birth except real date of birth. And this fact was confirmed when will appeal and during review Entry Clearance Manager withdrew the first refusal but the problem now is that, The British high commission said to us that they have send my wife passport to the Nigeria immigration service in Abuja but she lives in Lagos that will should contact them.
The advice I’m seeking now is that since they have admitted that the mistake was from them, are they not suppose to be the one to retrieve my wife passport from the Nigeria Immigration service since they send it to them.

Please I need urgent advice and God bless

Best Regards,

Jmendy3
