Yahaya Bello Can Not Be Governor Of Kogi – PDP

The Peoples Democratic Party has said the declaration of the All Progressive Congress’ Yahaya Bello as governor-elect of Kogi State is a waste of time.
This comes after INEC had declared Bello as winner of the governorship election.The National Publicity Secretary of the PDP, Chief Olisa Metuh, in a statement in Abuja on Sunday said,

    “The action of INEC in trying to transfer the votes earlier garnered by the dead APC candidate, Prince Audu Abubakar, to another individual is completely impractical and alien to the nation’s Constitution and the Electoral Act.

    “The declaration by INEC that Bello polled the highest number of votes is an embarrassing travesty of the nation’s democracy and electoral process.“Not only that this individual is not in anyway a valid candidate in the election, he also did not score the overall votes declared against his name by INEC and cannot be declared winner under any circumstance within the provisions of our laws.It is therefore unfortunate that INEC disregarded the provisions of the Constitution and the Electoral Act, which left it with no other legitimate option than to declare Governor Idris Wada the governor-elect,

    “Instead, it went ahead to preside over a charade, for which it is now attempting to illicitly handover the vote cast for a dead man to another person, who did not participate in the overall election.”

Metuh called on APC and Bello to know that Wada remains “validly elected within the dictates of our laws under the circumstance.”
He appealed to members of the PDP and its supporters to remain calm, saying the law will soon take the center stage to “right the wrong created by INEC and declare Wada as the governor.”

Mr. Metuh, what really does the constitution says??? Your candidate went to court, and the case was interpreted before d election. Pls, go back to court and stop causing confusion.

The Vote is for the Late Candidate and should never be Transferred to an unknown person.....He has to contest his own Election

Mr Metuh leave dat thing. Inec and d judiciary is under d president command. Pls lawyers in d house can u educate us on dis. Dis INEC do d right thing by making dis Yahaya d govt? is it constitutional? We have to know cus Nigeria belong to us all. Am waiting for someone to educate me serious

if a duly elected governor dies in office, is he replaced by another person or a new election conducted?

Seriously i dnt knw the problem of these nigeria politician, people of kogi state hav made her voice to choose whom they want. Even if inec dnt join the audu vote to bello the saturday has shows kogi state people dnt want wada again.

Does anybody question Metu's legal knowledge of the Nigerian constitution? I don't think he is speaking from a personal perspective in this matter. If it is not the Nigerian Constitution to inherit votes already cast in a previous election, why would INEC assume the votes belong to any APC candidate of their choice. Secondly, were the votes cast along party line or as general election choice of candidature? Democratic election means let the people decide, not let an election body impose result on the people. Neither Party nor a candidate should inherit votes from an election that was nullified. Was it called supplemental election, if so, who were the people considered legible to cast votes this time: elected official, citizens in diaspora, handicapped people who could not cast their votes in the general elections, those people whose ballots were not readable by scanners, military people on out of country mission etc. If the second election was conducted involving all the citizens of the state as in general election, there should be no inheritance to previous votes cast.

I think if the hav declared that he his the winner the PDP should give it up for the winner and stop commenting such.
