KAPIRI Mposhi magistrate Estone Kafunyi has sentenced a 27-year-old man to five years imprisonment with hard labour for having sex with a pregnant goat.
Before court on Tuesday was Amon Chisenga of Kabati village in Lunchu B in chief Mukonchi’s area. Particulars before court were that on July 4, 2010 around 03:00 hours, Chisenga did have carnal knowledge on a female goat contrary to Section 155 b of the Penal Code, Chapter 87 of the Laws of Zambia.
Chisenga pleaded not guilty to the charge when it was read for him. The state called witnesses Febby Kunda and John Kunda who were not challenged by Chisenga during cross examination, other than one question to Febby which the court said was only confirmation that the accused now convict had sex with the pregnant goat.
Both prosecution witnesses told the court that they found Chisenga in a kraal having sex with a goat around 03:00 hours and that it was not the first time that they found Chisenga having sex with a goat in their kraal. The duo said Chisenga was found in a similar situation but he had tendered an apology and, subsequently, promised never to have sex with an animal again. The court heard that the pregnant goat later died before it could be ferried to Kapiri Mposhi police station.
And detective constable Charles Bwalya, who happened to be the arresting officer, told court that during his investigations, he found that the female goat had a swollen vulva. He added that after obtaining a disposal letter from the subordinate court, the goat was buried at Kapiri Mposhi police station premises in a ditch dug by Chisenga himself. In mitigation, Chisenga said he had nothing to say. Passing judgment, magistrate Kafunyi observed that by having sex with an animal, Chisenga was being inhuman.
“The offence you committed is very inhuman. It is a serious offence and attracts a 14-year custodial sentence,” said magistrate Kafunyi. “Surely, even in villages there are a lot of unmarried women that you could have approached. But being a first offender, you will serve five years imprisonment with hard labour with effect from the date of your arrest.�
