45-Yrs-Old Man, Adetunji Tunde Jailed Over N2M Mistakenly Credited To His Account

A 45-year-old chauffeur, Adetunji Tunde Oluwasegun, has been sentenced to two years imprisonment for fraudulently converting to personal use the N2million that was mistakenly credited to his account.
The Ilorin Zonal Office of the Economic and Financial Crimes Commission (EFCC) had on Monday, January 18, 2021 arraigned Oluwasegun on one-count charge bordering on stealing before Justice Sikiru Oyinloye of the Kwara State High Court sitting in Ilorin.

The offence contravenes Section 286 and punishable under Section 287 of the Penal Code.

The charge read:

“That you, Adetunji Tunde Oluwasegun, sometime between the month of July, 2020 and 21st of August, 2020 at Ilorin, Kwara State, within the jurisdiction of this Honourable Court dishonestly took the sum of N2,000,000.00 (Two Million Naira), property of Sherifat Omolara Sanni, which she erroneously transferred to your bank account 0008383333 domiciled with Guaranty Trust Bank plc, without her consent and thereby committed an offence contrary to Section 286 of the Penal Code and punishable under Section 287 of the same Penal Code”
Oluwasegun pleaded ‘guilty’ to the charge when it was read to him.

Justice Oyinloye found Oluwasegun guilty of the offence and sentenced him to two years imprisonment with a fine of N200, 000 (Two Hundred Thousand Naira).

The judge also ordered the convict to restitute his victim the sum of N2million before he finished serving his jail term.

The judgement is unfair, in as much as what he did was wrong, the bank should be held responsible for the mistake, and instead of jail term, they should have make him sign an agreement and aske him how he wishes to refund the whole money. This kind of a case happened to someone i knew & he refunded the whole money back at his own convenience period of time.

Hello,
The judgment is more than fair. As a matter of fact, it is not enough. Why do we like to cover-up illegality? Some spent money mistakenly transferred to his account and you said sentencing him to prison is not right? How will you feel if you are the victim? Nigeria is the only place where people praise thieves. What they did to him will serve as a deterrent to others.

The judgement is fair but the sentence term of 2 years was too harsh. He should have been sentenced to 6 month and at the same time, compelled him to pay back the N2m within the sentence time period. I extend my concern to those pastors that share fake testimonies on how they miraculously received a credit alert in their account from unknown person's and claimed it was from God.
