The ACN governorship aspirants, Professor Wale Oyemakinde,Professor Wole Akinboade and Honourable Soji Akanbi in the suit filed on their behalf by Barrister Olalekan Ojo listed Senator Ajimobi as the first defendant, Action Congress of Nigeria (ACN) and the Independent National Electoral Commission (INEC) as the second and third defendants.
In the originating summon filed before the court, the three ACN governorship aspirants prayed the court to declare that Senator Ajimobi was not “validly or lawfully nominated or chosen as the governorship candidate of the Action Congress of Nigeria (ACN).”
At the hearing of the suit, Barrister Ojo told the court that two applications including the originating summon were filed by his client before the court on Monday, February 14 onthe ACN governorship issue in Oyo State.
Barrister Ojo stressed that there was the need for the court to ensure that the status quo was maintained in the party as it was at the pre-selection of candidate for the party as well as by restraining the ACN, INEC from recognising Senator Ajimobi as the ACN governorship candidate for the April elections in Oyo State.
He pointed out that already, the defendants have served him their written addresses to his motion as well as their counter motion challenging the jurisdiction of the court to hear the suit.
Counsel to Senator Ajimobi and the ACN, Barrister Biodun Amole, said there was no basis asking the court to restrain the ACN governorship candidate and the matter since a motion challenging the jurisdiction of the court is already on ground.
Barrister Amole argued that Senator Ajimobi’s name had already been submitted to INEC and such, “there is nothing to be restrainted.”
It was at this point that Justice Johnson Shakarho asked the counsel to the ACN governorship aspirants to clearly spell out his motion before the court and what he wants the court to give order on since the counsel to Senator Ajimobi and the ACN had informed the court that the name of his client had been submitted to the INEC.
Responding, Barrister Ojo said the ACN aspirants were in court to seek an order stopping the candidature of Senator Ajimobi as the party’s governorship candidate for the April election on the ground that his ‘’nomination or selection’’ was against the provisions of the 2010 electoral Act.
