Justice Maryann Anenih of the Federal Capital Territory High Court has declined a bail application by Yahaya Bello, former Governor of Kogi State, ruling that the application was prematurely filed
Delivering her decision, Justice Anenih stated that the application, submitted before Bello was in custody or appeared before the court, was procedurally flawed. Bello is facing trial alongside two others over an alleged N110 billion money laundering case brought by the Economic and Financial Crimes Commission (EFCC).
In the bail application, Bello’s counsel, JB Daudu (SAN), argued that his client, a two-term governor of Kogi State, would not interfere with witnesses or abscond if granted bail. The prosecution counsel, Kemi Pinheiro, opposed the request, labeling the application “grossly incompetent” as it was submitted before Bello’s arraignment.
The court noted that Bello filed his application on November 22, but was taken into custody on November 26 and arraigned on November 27. Justice Anenih emphasized that under the Administration of Criminal Justice Act (ACJA), bail applications are valid only after arrest, detention, arraignment, or court appearance.
Meanwhile, the second defendant, Umar Oricha, was granted bail of N300 million with stringent conditions, including two sureties owning property worth the bail sum in Maitama, Abuja, and the submission of travel documents. Oricha will remain in custody until all bail conditions are met.
