Another N500 Million Alleged Defamatory Suit Filed Against Dele Farotimi By Olu Daramola

Olu Daramola, a Senior Advocate of Nigeria (SAN) and partner at Afe Babalola Law Chamber, has filed a defamation suit seeking N500,000 in damages against Tomilola Titus Farotimi, also known as Dele Farotimi. The suit, filed at the Ojodu Abiodun division of the Ogun State High Court on December 13, 2024, concerns alleged defamatory content in Farotimi's book *Nigeria and Its Criminal Justice System*.

The legal action comes shortly after a similar defamation suit was filed by Chief Afe Babalola (SAN) against Farotimi over statements in the same book. Daramola's suit, marked HCO/65/24, was filed by his lawyer, Iheanyichukwu C. Uwa.

In his writ, Daramola seeks a declaration that certain statements on page 64 of the book are defamatory, offensive, and damaging to his reputation. The suit claims the content has caused him to be viewed with ridicule and disrespect by the public, tarnishing his standing as a competent and trustworthy legal practitioner. Daramola argues that the statements in question have injured his character, prestige, and professional integrity.

The Senior Advocate is requesting that the court award N500,000 in general and exemplary damages. Additionally, he is seeking an order for Farotimi to issue an unreserved apology in two national newspapers, such as *The Guardian* and *The Punch*, retracting the defamatory statements. Daramola also wants the court to direct the destruction of all copies of the book, both physical and digital, currently circulating in Nigeria.

The suit includes a request for a perpetual injunction to prevent Farotimi from further publishing or circulating the book in any form. Furthermore, Daramola is seeking an order for interest to be charged on the judgment sum at a rate of 10% per annum until the debt is fully settled.

The court has yet to set a date for the hearing, as Farotimi, who is currently in the custody of the Nigerian Correctional Service, has not yet filed a response to the suit.
