The court  also held that initial report by the accused of a case of armed robbery against the deceased was proved to be a lie during investigation,  adding that there were contradictions in the convict’s  statement and oral testimony in court.

“It is the view of the court that there was no justification for the convict to have shot and killed the deceased, who was harmless as at the time of the incident,” the court held.

Justice Amaize further said that evidence from the Police Doctor, who performed post-mortem on the corpse showed damaged urinary bladder and profuse bleeding which led to the death of the victim.

The court also noted that evidence of one of the expert prosecution witness on the handling of arms and ammunition indicated that the Ak 47 rifle was not at the safety cache when the incident.

The trial judge held that the evidence of another prosecution witness present at the scene of the crime was not challenged, adding  that the evidence of a witness called by the Sergeant was questionable as there was no summons on the witness to come and testify in court.

Saying that the prosecution proved the case of murder against the accused beyond reasonable doubt as stated by law, Justice Amaize sentenced the Police Sergeant to death by hanging under Section 319 of the Criminal Code.


 this is a nice post about NIGERIA, a good expression of the expected change. nobody does not like justice. justice and lesson for police men who believe  in accidental discharge' for a trained profession like theirs, killing innocent people everyday without even preparation for any query. serves him right and better if it continue like this.

So sad reading this......  Sad Sad No matter what I don't celebrate or rejoice seeing a man drop dead neither seeing an officer been sentenced to death this way or another.. is not a good thing, I think is high time Nigeria Govt should withdraw guns from the officers, esp those working in public areas and hand them teaser with less electrode power, because i know they will be using the teaser anyhow too, but is more better than shooting someone a bullet... Bullet kills but teaser will not unless that person is having problem with heart that could lead to death and depends on where the person is been shoot.

Our NPF are not well trained to handle guns !! they're so sick in the brain and feel like they have veto power handling guns. Govt should start thinking fast on what to do and the kind of people they recruit in police jobs... To be a police officer, one need to know the laws and also respect the laws and the people.
