Unlike in Nigeria, it is the jurisdiction of the component sates to fix the age limit. In all the states except New York, North Carolina, and Texas, it's 18. In the 3 mentioned states, it's 17. However, in alcohol related matters, it's 21 all over. Be that as it may, there'r so many exceptions depending on individual cases. There'r many 'minors' (...14yrs, 15yrs, 16yrs...) already serving their terms in the different US prisons while others are kept in juvenile prisons.

We are talking of high school and in US the highest age in high school is 18, so there is no way the student will be older than the tutor. But if that occurs, is not against the law...
