The case, number MEV/841C/2008, between Edo State Commissioner of Police and Reverend Nosa Peter Omoregie and others now at large, which came up on Friday before an Evbuoriaria Magistrate Court in Benin City, could not be heard following the absence of the presiding magistrate who was said to be bereaved.
Omoregie and others, said to be at large, had been arraigned on 9 September, 2008 on a four-count charge to which he pleaded not guilty and was granted bail. One of the allegations was that the suspects conspired to publish defamatory matters and thereby committed an offence punishable under Section 516 of the Criminal Code, Cap. 48, Vol. 11, Laws of the defunct Bendel State 1976, as applicable in Edo State.
Omoregie was also accused of publication of defamatory matter when he declared last month at the Anglican Bishop’s Court in Benin City that Rt. Revd Imasuen was involved in the act of procuring an abortion with one Gladys Adetokhai, thereby committing an offence said to be punishable under Section 375 of the Criminal Code.
It was also learnt that the accused persons, on or about the month of July and August 2008, at St. Andrew’s Anglican Church, Uselu, St. Thomas Anglican Church, New Lagos Road and the Cathedral Church of St. Matthew, all in Benin City, displayed conduct likely to cause breach of peace, and thereby committed an offence punishable under Section 516 of the Criminal Code.
The accused persons were also arraigned for pasting publications that Bishop Imasuen was involved in the act of procuring abortion with one Gladys Adetokhai, which was an act likely to cause breach of peace and thereby committed an offence punishable under Section 249 (d) of the Criminal Code.
