Garki Hospital has dragged the Inspector-General of Police, Mr. Hafiz Ringim, and the Attorney-General of the Federation and Minister of Justice, Mr. Mohammed Adoke (SAN), to an Abuja High Court over the alleged detention and violation of the fundamental human rights of two nurses, Mrs. Patience Nnaukwu and Miss Bernice Amenaghawon.

PUNCH METRO had in August exclusively reported in a story titled, “Our twins died because we couldn’t pay N100,000 hospital fee,” that Nnaukwu and Amenaghawon were arrested and detained by the police after the premature twins died.

Nnaukwu and Amenaghawon, the two nurses on duty, allegedly refused to admit the premature twins to the hospital when their parents could not deposit N100,000 purportedly demanded by the hospital.

Apart from the hospital, other plaintiffs in the suit are the two nurses and the hospital’s Clinical Director, Dr. Ahmed Abdullahi.

Other defendants are a lawyer from Festus Keyamo chambers, Mr. Ahmed Tijani; the twins’ uncle, Abubakar Yusuf; a police officer, Sgt. Imafidon Sunday; Divisional Police Officer, Divisional Crime Officer, Garki Division, and Commissioner of Police, FCT Command.

In a motion exparte filed by their lawyer, Mr. Peter Ofikwu, the plaintiffs are asking the court to order the police to pay the hospital N100m damages for the unlawful and unconstitutional arrest and detention of Nnaukwu and Amenaghawon on September 7, 2010, from about 10 am to about 11.30 pm.

The plaintiffs said two premature twins that needed incubators were referred to Garki Hospital after they were delivered at Maitama General Hospital on that fateful day.

Amenaghawon said two women and Yusuf brought the babies. She added that she called a senior member of the hospital’s management staff on the telephone whether the babies should be admitted to the hospital without the payment of N1,500 registration and N50,000 deposit.

She said before she could get her boss’ approval, the people that brought the twins had left, adding that Yusuf said he had only N3,000 with him.

But in their joint counter-affidavit deposed to by Tijani, Yusuf said Nnaukwu and Amenaghawom, whom they met at the reception, insisted that N2,000 for the hospital’s card and another N100,000 deposit must be paid before the babies were admitted.

“The father of the twins paid and obtained the hospital’s card but pleaded passionately with the nurses to allow them to see any doctor on duty and that he (Tijani) will produce the money later that morning because it was too early for him to make a deposit of N100,000,” Yusuf said.

The twins’ mother, Mrs. Fatimah Ibrahim, had in August told PUNCH METRO that she took her babies to different hospitals in Abuja after they were delivered around 2:30am. She said the babies needed incubators to survive, but ironically, none of the hospitals visited had incubator.

She said at Nisa Premier Hospital, Kado, Abuja, there was one incubator but the doctors refused to admit the babies on the ground that they were not delivered at the hospital and admitting them could put other babies delivered at Nisa at risk.

It was gathered that by the time the babies were taken back to Maitama General Hospital, it was already late. The premature twins died of severe cold at 4am. Their remains were later buried at Gwarinpa Estate Cemetery around 7am on August 21.

Eyah .... but do we blame the Nurses? when they were carrying out their so called legitimate duty? well may their (babies)  little Gentle soul rest in peace Amen.

With the resources we have in this country, Do we need to pay for such huge amount of money in our general hospital? What a shame.

We are talking about two precious lives here. I understand in nigeria, the resources are more limited, but the family were pleading to pay the money later. The doctors should have taken in the twins then reconsider this action later if the family failed to pay the money. Their action did not give the family or the twins a chance.
