Al-Mustapha: Lagos to appeal against acquittal

The Lagos State Government on Wednesday said it would appeal against the judgment of a Lagos High Court, which discharged and acquitted a former Chief Security Officer to the late Gen. Sani Abacha, and three others.



Al-Mustapha, a former Commissioner of Police, Lagos State Command, James Danbaba, a former Military Administrator of Zamfara State; Lt.-Col. Jibrin Yakubu; and a former head of the Aso Rock Anti -Riot Police, Mohammed Rabo Lawal, had been on trial for their alleged involvement in the attempted murder of the publisher of The Guardian Newspapers, Mr. Alex Ibru.

The Attorney-General and Commissioner for Justice, Mr. Supo Sashore, (SAN), said in a statement that the state would file a notice of appeal immediately against the court verdict.

Sashore stated this just as the Nigerian Prisons Service said it had released Danbaba and Yakubu.

Spokesman of the NPS, Lagos State Command, Mr. Ope Fatinikun, confirmed to our correspondents that Danbaba and Yakubu were released early Wednesday from Kirikiri Prisons, Apapa.

“They came in late on Tuesday, after they were discharged and acquitted, so we could not conclude the process of their release. But they left this morning,” he said.

Fatinikun, however, added that al-Mustapha and Lawal were still with the NPS.

while the innocent ones suffer in jail.
Our Prisons over-flow with innocent people
while people who are supposed to be there are free

Lagos State's decision to apeal the acquital of accused conspirators in the Alex Ibru case is a good one. It is difficult to comprehend how Justice Mufta Olokooba reached his verdict. There is every indications that the accused are not innocent and the prosecutors presented a good case. Hopefully the appeal Court will examine the case and revise Justice
olokooba's ruling.

Too often defendants in high profile cases are set free by our judicial system. This is the reason why crimes
by the elite, rich and priviledged persist in our nation today. They are never convincted. It is begininig to look like a two system
of justice where they poor are always convincted and the rich (and priviledged) always set free.

The only way to put Justice back in the judiciary is to get rid of most of the Justices we have today and
replace them with Justices that will practice equal justice for all.
