Traditional and white(church) weddings are not recognized by the law...which makes a court marriage more superior.

A court cannot dissolve a traditional, church(white weddings) cause its not recognised.

Oya toks come answer my brother.. Debate starts...
In America without court wedding u are not recognize as a married person... U have to do that to put your status as married... That's their law here
Whether church oh or tradition oh u still have to do court wedding ... Even pastors here advise u to get the court wedding done first before the church own..

In Asia which is the largest continent..,I cannot remember any country where the court marriage is recognized that much...Asians valued their respective traditional ways of life more any other ones own..,and that was why the Europeans did not have much impact on them......so tell me how court marriage is recognized by the law.

Because a marriage affects property ownership, rights of survivorship, spousal benefits, and other marital amenities. Marriage is a matter that has to be regulated by law because a whole lot of paper work has to be done.

No documents are signed in traditional/church marriage. It becomes difficult to write a will, since the person isn't technically married.

chaaiii....oyibo don give us brainwash education to make us the fools.......my brother if that is the case then there is no nid to prolong the matter bcuz Nigerian constitution which was implemented by the law makers did not say neither traditional nor church marriage is not recognized....even sharia law which stated that sixty yr old man will marry a 13yr old girl was recognized in Nigeria constitution and dat was what senator yerima quoted to them that shuts every body up.......so I dont think they are not recognized by the law....... beside pple marries more than one wife and still share their properties b4 they die if they want to do so without inviting any lawyer..

One of the reason why court wedding is very important and more important than the traditional wedding is because of the woman and her children... Like toks said with court wedding the wealth can be share equally between the man and the woman... If not the man will clam everything and leave the woman nothing ...same goes If the woman is richer than the man...

this tread is going to another dimension now.....Hope ur topic was "Traditional marriage or white wedding" ..but I tell u what....bcuz of all these sharing of assets between man and woman is why court marriage don't last....bcuz it was based on material things.....check out the United States where it is practiced and see they have the highest number of divorced....Recently Janet Jackson accepted to marry an Arab man due to the money which will be paid to her if they divorce.....and u call that marriage.....in Africa our own style is best for us

Well, i don't have a copy of the 1999 constitution as amend...which is a shame but i think yerima was basing his arguments on the part of the constitution that allows people to practice their religion without fear.

I don't think i explained well enough about "traditional/church marriage not being recognised"

Eg. A man marries a wife in the traditional way then goes for a court marriage and seals it. He got tired of the marriage and got a second wife traditionally and drove the first wife away.

The first wife can and has the right to go to court and dissolve the 2nd marriage because the first marriage has not been dissolved by the court which means the 2nd wife and all the children she has with the man are illegal.

Case point Chief M.K.O Abiola
There are so many examples.

Now the other part. Absence of Wills have caused wars and the court seems to be the only place to get justice.

So how do you write a will if your marriage isn't recognised in the law?

Well, how will you divide your companies, estates etc?
