Woman Sues Shell For N750m

A former staff of Shell Petroleum Development Company, Mrs. Sheri King has dragged her former employer before the Igbosere High Court, Lagos claiming N750 million damages for permanent disability of her 17-year old son, Opeyemi.

Also joined in the suit is the medical personnel of Shell Medical Centre, Dr. Fred Eigbe who was accused of improper diagosis which led to Opeyemi suffering acute distress during the claimant’s prolonged labour.

In the suit filed before Justice Okwuobi, the embittered mother of three claimed that the negligence of the defendants had inflicted permanent injury on her and her son, adding that Opeyemi was unable to achieve the usual milestones of childhood – crawling, walking, and talking.

She averred that the first defendant engaged the services of the second defendant in the medical centre, stressing that the second defendant lacked the requisite skill and knowledge which led to her son suffering cerebral palsy.

The claimant told the court in her affidavit that she was an employee of the company and by privilege, entitled to use the medical centre.

She said that when she was pregnant, she attended the ante-natal clinic for medical checks at the centre where the second defendant was the senior medical officer. She claimed that she gave them all her medical records as she had previously had a baby through caesarian operation.

“When I went into labour, my husband took me to the hospital and the nurses on duty received me at about 2 a.m. and immediately phoned the first defendant but he did not show up until 12noon. Before then, my baby had struggled and became weak,” she stated.

She claimed that it was the result of negligence by the defendants that caused the incapacitation of her son who had been a burden to her for the past 17 years.

“He cannot walk, talk or do anything without human assistance,” she revealed.

She said when she protested that they were responsible for her son’s condition and thinking that she will take legal steps, they assisted in his treatment which they stopped after failing to force her sign a document that it was not the defendants’ that caused her son’s sickness.

“All efforts to send the boy abroad for proper medical attention was declined by the defendants.”

The defendants, on their part, denied the allegations, insisting that they assisted the claimant as a staff of the company.

When the matter came up in the court, there were several applications and motions on the matter and some have not been served as required by law.

Following this, the court adjourned the matter till 24 May, 2010 to enable the service of the necessary papers on the parties.

This woman should use her money for other reasonable things
 and not to drag the doctor who helped her in her child delivering
 ,which is believed to be a successful delievering in the first place
to court." Doctors treat but God cure". The child has this incapacitance
 right from the mother's womb which could be articulated to other medical
problem or defficiency. To crown it all i advise her to stop making trouble and
 resort to prayer as no being can gain anything good from case.

Causes of Cerebral Palsy

Why does your child have cerebral palsy? The simplest answer to this question is because your child has brain damage. This leads naturally into the second question: Why does your child have brain damage? There are many possible answers to this second question, because there are many reasons children can sustain brain damage. Cerebral palsy is caused by an injury to the brain before, during, or shortly after birth. In many cases, no one knows for sure what caused the brain injury or what may have been done to prevent the injury. Failure of the brain to develop properly (developmental brain malformation)
Neurological damage to the child's developing brain

Whatever the cause of your child's cerebral palsy, the severity of the brain damage generally depends on the type and timing of the injury. For example, in very premature babies, bleeding into the brain (intraventricular hemorrhage) can cause extensive damage. Also, the longer an unborn child goes without oxygen, the greater the extent of brain tissue damage.

Ten to fifteen percent of cerebral palsy is caused from a recognized brain injury, such as infection (like meningitis), bleeding into the brain, and damage caused by lack of oxygen. It is very important that you understand that a brain injury caused during delivery in many cases could have been prevented. Medical mistakes are responsible for thousands and thousands of cerebral palsy cases. It would be virtually impossible for a parent, on their own, to determine if a medical mistake caused their child's cerebral palsy or brain damage. It is only through the concerted efforts of a legal/medical team that can answer the question, "was my child's cerebral palsy preventable?"

So this lady want this to make bad for others. Suppose Shell use this case to stop offering these services. I have seen a lot of women give birth while the doctor not around and their children is healthy. Neglect of the parents caused this. Anyway am curious about this case. I hope I will not be too busy when this case kick off.

for heavens sake....why r people like this....this doctors are human....they make mistakes 2.....how many times do people in other professions make mistakes nd they r not sued for any thing....lawyers lose cases...nothin happens to them.....students fail..no one sues the teachers......even these annoyin judges pass wrong judgments at times nd they r not punished when the cases r overruled in appeal courts.......but when a doctor makes a mistake, his company is sued for N750 mills......i think itz a bit of greed nd using the child opportunistically.....u used their services..they didn't force you to....things turned out wrong....tell them to find a way 2 fix it.....3/4 of a billion naira wouldn't stop ur son from being disabled???..........give medics a break...these guyz work round the clock......u'll know wat i mean if u're related to one of them.........mistakes are always made!!!
