The Federal High Court in Lagos has adjourned the trial of Lagos-based businessman, Olutoye Remi-John, until January 14, 2025. Remi-John, the Director of TRJ Company Limited, faces charges of conspiracy, obtaining property by false pretence, and the conversion of N39 million.
The charges against Remi-John stem from an alleged fraudulent transaction involving his co-accused, Emeka Ndukwe, who remains at large. According to a three-count charge filed by Police Legal Officer Zebedee Arekhandia of the Zone Two Police Command, Onikan, Lagos, the pair are accused of defrauding a businessman, Mr. Michael Etieobhio Omofoma, by falsely offering to sell a property for N60 million.
In the first charge, Remi-John and Ndukwe are accused of conspiring to commit a felony on November 4, 2022, in Ikeja, Lagos. They allegedly intended to defraud by obtaining property through false pretenses, in violation of Section 8(a) and punishable under Section 1(3) of the Advance Fee Fraud and Other Fraud-Related Offences Act, 2006.
The second charge alleges that Remi-John and Ndukwe fraudulently obtained N60 million from Omofoma by falsely claiming they would sell him a property located at No. 37, Aba Johnson Crescent, Off Adeniyi Jones Avenue, Ikeja. The prosecution asserts that Remi-John knew the claim was false, thus committing an offense under Section 1(3)(a) of the Advance Fee Fraud Act.
The third count accuses Remi-John of converting N39 million of the N60 million for personal use between November 4 and December 31, 2022. The charge claims that he was aware, or should have been aware, that the funds were proceeds of a criminal act, in violation of Section 15(1) of the Money Laundering (Prohibition) Act, 2011, as amended in 2012.
The court adjourned the case to allow further proceedings on the charges, leaving Remi-John’s fate to be determined in January 2025.
