The Lagos State Government has announced its intention to challenge the recent ruling by the Court of Appeal, which overturned the conviction of Dr. Femi Olaleye, a medical doctor found guilty of defiling his wife’s niece.
In a statement, the government, led by Governor Babajide Sanwo-Olu, confirmed plans to take the case to the Supreme Court. The aim is to appeal the judgment and seek a reversal of the Court of Appeal’s decision.
The controversial ruling, made by the Court of Appeal in Lagos on Friday, effectively voided the conviction of Olaleye, the Managing Director of Optimal Cancer Care Foundation. The appellate court found that the lower court had made an error in its judgment, leading to the discharge and acquittal of Olaleye.
Olaleye had been convicted in October by the special offences and domestic violence court in Lagos, where he was sentenced to life imprisonment after being found guilty of two counts of defilement and segxwal assault by penetration. The Lagos State Government had brought charges against him, and Justice Rahman Oshodi had sentenced him to life in prison.
However, the Court of Appeal criticized the evidence presented in the case, describing it as “tainted” and “unreliable.”
In response to the ruling, civil rights groups have petitioned the Lagos State Attorney General, Lawal Pedro, SAN, urging him to seek a higher court's intervention to restore public confidence in the justice system.
Reports indicate that the Lagos State Government has now officially filed a notice of appeal at the Court of Appeal, signaling its readiness to pursue the case in the Supreme Court for a final determination on the matter.
