You've said it all. If this story is true and not made up, then it brings the Nigerian judicial reasoning into question. I concur with you that in the fact provided, the accused seems to argue about non-injury, he neither denied the allegation of rape nor the incident ever happening. Therefore, its only correct to say that rape, as defined by the Criminal Code, is a crime, and if indeed the accused admits to molesting the claimant, then injuries or no injuries, he is guilty of the offense of rape, and must be prosecuted accordingly.
