A 29-year-old applicant, Franca James, Tuesday told an Abuja magistrate that one Kelvin Samuel had sex with her in a public place at Wuse Zone 4 and refused to pay for the act.
Prosecutor Adamu Abdullahi had earlier informed the court that on August 27, a police patrol team led by sergeant Aboh caught Franca James of Mpape Village and Kelvin Samuel of 12 Mogaji Street, Karmo, constituting themselves into nuisances ( by having sex) in a public place, and causing annoyance to the inhabitants of the area.
The prosecutor told the court that the offence is punishable under Section 183 of the Penal Code.
When the charges were read to them, Franca pleaded guilty and begged the court to temper justice with mercy, saying she will not behave in such manner again.
Kelvin denied the charges and requested for bail, which was objected to by the prosecutor, who asked for a hearing date to commence his trial.
Magistrate Okeagu Azubike cautioned Franca and granted Kelvin bail in the sum of N50,000 with a surety in like sum, who must reside within the court’s jurisdiction with a fixed address.
The case was adjourned to September 16 for hearing.
