
A Mapo Grade A Customary Court in Ibadan has ended the 21-year marriage between Omotayo Kumunyi, a caterer, and her husband, Olatunde, following serious allegations of domestic abuse and poisoning.
Kumunyi, a resident of Osungbade in Ibadan, sought the dissolution of the marriage, citing that Olatunde had neglected his responsibilities as a husband and father to their four children. She claimed that he had regularly subjected her and their children to physical abuse and even poisoned her food.
In her testimony, Kumunyi revealed that her third child had confided in her about seeing Olatunde pour a suspicious black substance into her food. When confronted, Olatunde reportedly refused to eat the food. Kumunyi also alleged that Olatunde regularly beat her and their first child whenever they crossed paths.
In addition to seeking the dissolution of the marriage, Kumunyi requested custody of their children, fearing that Olatunde would not provide adequate care for them. She stated that she had already moved out of the family home with three of her children, leaving the second child behind.
Olatunde, a carpenter residing in the Challenge area of Ibadan, did not address most of the accusations but admitted to having paid the dowry for the marriage. He contested the custody of the children, stating that Kumunyi had mistreated their two youngest children. He proposed a monthly upkeep of N5,000 for the children, conditional on not losing custody.
In her ruling, the court’s President, Mrs. S.M. Akintayo, confirmed the dissolution of the marriage, based on the evidence provided. She granted Kumunyi custody of the last three children and ordered Olatunde to pay a monthly allowance of N20,000 for their upkeep, in addition to taking responsibility for their education and welfare.
As for the eldest child, now 18, the court affirmed their legal right to choose which parent to live with. Mrs. Akintayo also issued a restraining order against Olatunde, prohibiting him from harassing, threatening, or interfering with Kumunyi's life.
This ruling brings an end to a troubled marriage marked by serious allegations of abuse and neglect.
