Attempts by Governor Gbenga Daniel of Ogun State and the factional governorship candidate of the Peoples Democratic Party (PDP), Mr. Gboyega Nasir Isiaka and others in Ogun State to stop the Independent National Electoral Commission (INEC) and the Peoples Democratic Party (PDP) from substituting their names with others suffered a set back yesterday.
A Federal High Court sitting in Abeokuta, yesterday rejected the application brought before it on the matter and also reserved hearing in the exparte motion filed by the appellants indefinitely. The motion filed by Daniel and others is seeking to restrain INEC and the headquarters of the ruling (PDP) from substituting their names and others earlier forwarded to the electoral body with General Adetunji Olurin and others.
According to the presiding judge, Justice Ofilli-Ajumogobia, the exparte was capable of creating confusion in the judiciary. Her words: ‘’. I will like to avoid confusion on this matter. This is a matter that affects a single party and other party as a factor to the matter”.
Ofilli-Ajumogobia, who turned down the application however, directed that INEC, PDP, Olurin and others must be properly served and a proof of service should be brought before her.
She adds: “As soon as they are properly put on notice and a proof of service is secured, the court will fix the date for further hearing”
Reacting to the development, the Counsel to Olurin and others, Mr.
Ajibola Oloyede described the step taken by Daniel and others in the case as an act of dragging judiciary into political confusion, saying that they wanted to turn judges against one another”.
His words: “They want to drag judiciary into political contest. They want to turn judges against one another.
Oloyede further stated that Joju Fadairo-led faction miscalculated by taking their case to a judge” that knows his onions who put them in their place, by quickly dismissing their application”
In his own reaction, counsel to Joju Fadairo-led faction, Mr. Yemi
