A Nigerian woman living in Germany, Adenike Obaoye, has taken to social media to accuse German authorities of unlawfully retaining custody of her two young sons, despite her claim that they are not German citizens and should be allowed to return with her to Nigeria.
In a video posted to her TikTok account on Monday, Obaoye expressed frustration after a Berlin-Kreuzberg family court, presided over by a female judge, reportedly denied her request to travel back to Nigeria with her children, Noah and David, born in August 2021 and July 2022 respectively.
“Done with the Family Court at Berlin-Kreuzberg and the German female judge refused to release my non-German children to travel to Nigeria as I demanded,” Obaoye wrote in a caption accompanying the video.
The woman, who identified herself as a single mother with full custody, insisted that both children are Nigerian citizens and have no legal ties to Germany in terms of citizenship.
“Germany refused to release non-German children, claiming they want the children to remain in Germany, which is a violation of the children’s rights and my rights as their mother,” she alleged.
She further accused the German state of attempting to carry out what she termed a “state kidnapping,” suggesting that officials were seeking to wrongfully take over guardianship of her sons. “Germans want to inherit children that are not theirs,” she said.
Obaoye, who is reportedly divorced, declared her intention to continue fighting what she described as an unjust ruling. “This justice will not last. I’m still going to fight it,” she vowed.
As of the time of reporting, efforts to obtain clarification from Obaoye regarding the legal grounds for the court’s decision were unsuccessful, as she did not respond to multiple inquiries.
The case has sparked debate online, with many calling for transparency from both the German authorities and the Nigerian consulate in Berlin regarding the children’s legal status and welfare.
