Osazee Kenneth Imagbenikaro has been convicted by Justice C.A. Obiozor of the Federal High Court in Benin City for the offense of spraying naira notes at a funeral ceremony on April 28, 2023.

Imagbenikaro admitted guilty to the charges brought against him, which were based on Section 21(3) of the Central Bank of Nigeria (Establishment) Act 2007.

This section specifically prohibits the spraying of naira notes, a practice considered to be an abuse of the national currency.

During the court proceedings, the prosecution counsel, Francis Jirbo, advocated for a conviction and appropriate sentencing in line with Imagbenikaro’s guilty plea.

In contrast, the defense counsel sought leniency from the court, emphasizing Imagbenikaro’s remorseful attitude and appealing for a merciful consideration in his sentencing.

After reviewing the case, Justice Obiozor imposed a sentence of six months’ imprisonment for each of the two counts, with the alternative of paying a fine of N100,000 (One Hundred
Thousand Naira) per count.

Furthermore, as part of the sentence, Imagbenikaro is required to submit a written undertaking, pledging to exhibit good behavior in the future.
