Federal Government Takes Governors To Supreme Court Over Local Government Autonomy

The federal government has filed a lawsuit against the 36 state governors before the Supreme Court to ensure the autonomy of the nation’s local governments. The case, marked SC/CV/343/2024, was filed on May 20 by the Attorney General of the Federation and Minister of Justice, Lateef Fagbemi (SAN), on behalf of the federal government.

In the suit, the federal government is seeking an order from the Supreme Court to prohibit state governors from unilaterally, arbitrarily, and unlawfully dissolving democratically elected local government leaders. The government argues that such actions violate the constitutional provisions for local government autonomy.

Additionally, the federal government is requesting that funds designated for local governments be directly disbursed to them from the federation account, bypassing the alleged unlawful joint accounts created by governors. This move aims to ensure that local governments receive their funds directly, as stipulated by the Constitution.

The suit also seeks to prevent governors from appointing caretaker committees to manage local government affairs, advocating instead for the constitutionally mandated democratic system of governance at the local level.

Furthermore, the federal government is asking for an injunction to restrain governors, their agents, and associates from receiving, spending, or tampering with funds allocated from the Federation Account for the benefit of local governments in the absence of a democratically elected local government system in the states.

The case underscores the ongoing tension between federal and state authorities over the governance and financial autonomy of local governments across Nigeria.

Local governments must be autonomous, as there are three tier governments: Federal state and local, each must stand on its own. Nigerian  governors are greedy, heartless and wicked. Federal government should take over states if they refuse the autonomy of local governments
