FORMER SPEAKER BANKOLE FILES APPLICATION TO DISQUALIFY EFCC PROSECUTOR, KEYAMO

Former Speaker of the House of Representatives, Dimeji Bankole, Monday filed an application before an Abuja High Court asking for an order to disqualify Mr. Festus Keyamo who was appointed by the Economic and Financial Crimes Commission to prosecute him for illegally obtaining  N38 billion loan.
The application which was filed by his lawyer, Chief Adegboyega Awomolo SAN, was premised on the ground that Keyamo had embarked on persecution of Bankole while he was in office as speaker.
Awomolo further premised the application on the following grounds: “That Mr. Keyamo as a private legal practitioner had envisaged the applicant in battles of allegation of corruption as the Speaker of the House of Reps which failed and was dismissed by the House Ethics Committee.
“That the prosecution of this case by Keyamo is a continuation of persecution, to destroy the applicant, an attack he had begun since October 2008.
“The prosecution of the allegation in this court by Keyamo can neither be objective nor inspire confidence or impartiality and independence as prosecutor,” he stated.
Bankole also stated that the prosecution by Keyamo was perceived as a continuation of hostility, antagonism and personal vendetta, using the prosecutorial power of the state.
He also claimed that allowing Keyamo to prosecute the case would amount to a violation of his right to fair hearing.
Citing the provisions of the Legislative Houses (Powers and Privileges) Act and the National Assembly Service Commission Act, Bankole had said that no court has the jurisdiction to try him for anything done by him while exercising his powers as the speaker of the lower chamber.
In an application to quash the charges of illegally obtaining N38 billion loans levelled against him before an Abuja High Court, Bankole,  said that there was no shred of evidence to sustain the 17 count charges.
He consequently asked the court to direct the chairman of the EFCC, Mrs. Farida Waziri to publicly apologize to him for public humiliation, denial of personal liberty, unlawful detention and discomfort to his person and family since Sunday 5th June, 2011.
In the application, Bankole’s lawyers punctured the entire charges one after the other claiming that the Economic and Financial Crimes Commission was acting under the mis-apprehension of the law or was merely persecuting the former speaker.
He asked the court to quash the charges also on the ground that EFCC had neither statutory nor constitutional power to issue authority to a private prosecutor, to prosecute offences created by or under the Penal Code Act in any court of law, without the FIAT of the Attorney-General of the Federation first being sought and obtained and usage of the powers as a vindictive weapon against the applicant.

 Roll Eyes ::)This bloody thief still has the nerve to talk abi...it is only in Nigeria where politicians loot and don't get caught. If this trial  were to be conducted abroad these thief would have been cooling his butt in jail now.
