A burly gym teacher is claiming a puny six-year-old student beat him up and caused him debilitating personal injury.

John Webster, a physical education teacher at P.S. 330 in Elmhurst, Queens, plans to sue New York City's Department of Education for failing to protect the 27-year-old against the pint-sized youngster - his lawyer dubbed 'a tiny terror.'
The teacher says a scuffle with Rodrigo Carpio, then 50 lbs, on April 26 has left him with an injured meniscus in his right knee and ligament damage to his right ankle.
Webster has been unable to work since the incident and is out on medical leave.
His lawyer, Andrew Siben of Bay Shore, Long Island, told the MailOnline that the teacher is seeking compensation for his medical expenses in addition to damages, which Siben would not specify.
The teacher, who had taught at the Queens public school for two years, claims the school was aware of the 'student's propensity to be explosive ... when he acted like a tiny terror' but they failed to adequately intercede.
The 27-year-old plans to sue the NYC Department of Education for failing to protect him.
Interesting.. The Guy, 4-foot-2 Rodrigo Carpio looks more like an angel to a Chinese but then, all of a sudden, that halo turns into horns. It's been a nightmare, embarrassing and humiliating for the 50-pound, 6-year-old student to have taken down a 5-foot-10 and 220 pounds, gym teacher John Webster.
Common sense is indeed not common.

Hey guys, i'm a law student in new york, i need to explain this topic well especially to my naija people. It is not that the little guy can beat the Teacher under normal circumstances,NO. but the teacher was very wise and he did the right thing for not retaliating or beating up the little boy, else it would have been a different ball game, trust me. The topic would have been 'School teacher (27yr old,weigh 220 pounds) beat up a 6yr old harmless school teen to coma! The headlines would have been so horrible and there would be a street protest and the judge will not waste time to award huge damage against the teacher and the school. this is america and people will provoke you to hit them so they can sue your ass and get damages.

Thanks my brother, I'm glad you explained it to them better, I also live in New York, got a job in a school to work as teachers assistant but I had to quit after 3 months cuz I couldn't take the insults and Moreso the things the kids go away with.... I no wan go jail so I jejely quit
