1. Background fact:  1.1 Bilie Human Rights Initiative is a human rights organization registered in Nigeria and in the United Nations Department of Economic and Social Affairs to protect and advocate for the rights of indigenous people of Biafra. By the provisions of Section 2B of the registered Constitution of Bilie Human Rights Initiative, its headquarters must be located

in Owerri, Imo State, with branches in all countries of the world that have seats in the United Nations.

By a legal instrument dated 13th Sept 2012 signed by the Council of Elders of indigenous people of Biafra, registered and filed in the Federal High Court of Nigeria, Bilie Human Rights Initiative was appointed by the Council of Elders under customary law pursuant to the Nigerian Constitution to act as the national liberation movement for all indigenous people of Biafra and represent them in their liberation struggle at both national and international levels.

Since Bilie advocates for the rights of indigenous people of Biafra, the Office it established for the Biafrans is called “Office of Indigenous People of Biafra” located at 90 Wetheral Road, Owerri, now renumbered as 92 Wetheral Road, Owerri, Imo State. It has also established the Anambra State branch of the Office of Indigenous People of Biafra located at Awka Road, Onitsha. All the Offices it establishes for the Biafrans in all parts of the world are called Offices of Indigenous People of Biafra in line with its mission statement.

1.2. Human Rights Law is a branch of the law that encapsulates the fundamental rights and freedoms given by God to mankind. All nations of the world (whether civilized or uncivilized) have adopted and enshrined the human rights law in their Constitutional Law. Nigeria is one of those nations (whether civilized or uncivilized) that practise the human rights law. To prove its belief in human rights law, Nigeria established the Nigerian Human Rights Commission by an Act of Parliament. Apart from the government’s human rights watchdog, many human rights organizations exist in Nigeria defending the rights of the common man. The question is not whether there are human rights organizations in Nigeria but how effective they are.

1.3 In commencing the legal action against the Federal Republic of Nigeria, all the indigenous people of Biafra being the remnants that were not consumed in the war formed an organization called Indigenous People of Biafra under Section 40 of the Constitution of the Federal Republic of Nigeria 1999 as an unregistered body of the Biafrans living in Nigeria and in exile with their council of elders as the leaders of the people under customary law. This is the body of all Biafrans in the world irrespective of their local associations or unions. As an unregistered body of Biafrans in Nigeria, the Indigenous People of Biafra can only sue or be sued in a representative capacity.

This was why the Council of Elders appointed Bilie Human Rights Initiative to represent Indigenous People of Biafra in their national liberation struggle. Consequently, the organization commenced the action in Suit No FHC/OW/CS/102/2012 on behalf of Indigenous People of Biafra against the Federal Government of Nigeria which was later renumbered as Suit No FHC/OW/CS/192/2013 seeking, inter alia, to exercise their right to self-determination...
