Confusion In Abia As Court Stops Chief Judge, From Swearing In Ogah As Governor

Not so fast, Uche Ogah won’t be getting to the number one seat soon. A High Court in Osisioma in Abia state, has restrained the Chief Judge of the state, from swearing in Uche Ogah who just received his certificate of return from INEC as the governor pending the determination of a suit filed against him.

The court presided over by Justice C.H. Ahuchaogu, delivering a ruling on an ex parte suit brought by the State Governor,  Dr. Okezie Ikpeazu against Uche Ogah, Independent National Electoral commission (INEC) and chief Judge of the Abia state, ordered that “an order of injunction is hereby made restraining the second defendant (INEC) from issuing a Certificate of return to the first defendant (Ogah) while claimant remains in office in accordance with Section 143(1) and (2) of the Electoral Act, 2010 (as amended) and pending the determination of the motion on notice”.



Justice Ahuchaogu also, further ordered, that “the third defendant (Abia Chief Judge) or any other judge of the court or any judicial officer are hereby restrained from swearing in the first defendant (Ogah) while the claimant remains in office.

No date was fixed for further hearing on the motion on notice.

This is the stay of execution that should have been served to INEC since yesterday so they can desist from issuing a return certificate to Ogar. I guess Ikpeazu lawyers had to rally round to get the order
today. Meanwhile, that order is not coming from an appellate court but rather from a State High Court which is of a lower jurisdiction. I hope Ikpeazu will not shoot himself in the foot
by getting a kangaroo court order rather than from the appellate court. This is the same way he hurriedly prepared a tax certificate with date as saturday.
