Court stops voters’ registration

A Federal High Court yesterday ordered the Independent National Electoral Commission (INEC) to put on hold the planned January 2011 voter registration exercise pending the determination of a suit brought against it.
Justice Ibrahim Auta gave the order after listening to an ex-parte application brought by Bedding Holding Limited against INEC, its chairman, Professor Attahiru Jega, the Attorney General of the Federation, Haier Electrical Appliances Limited, Zinox Technologies Limited and Avantee International Technology incorporated.

The plaintiff is contesting the abuse of his patent by INEC, with respect to the award of contract for the production and supply of direct data capture machines to the commission for the voters registration scheduled to begin in January 2011.
The plaintiff further told the court that INEC abused patent to the machines, as it was neither contacted nor informed of the need to use its registered patent in the voter registration, prior to awarding the contracts.

After listening to the motion ex-parte, Justice Auta ordered: “The defendants/respondent, either by themselves, agents, privies, contractors, surrogates or any other person or persons claiming, through them, are restrained from continuing with the process of considering proposals of tendering/bidding for, producing, procuring, supplying, acquiring, importing, buying, receiving, selling, leasing, alienating, applying or otherwise using the direct data capture machine.
The matter was further adjourned to December 13, 2010 for hearing.

In its claims, Bedding Holdings demands, “a declaration that it is the rightful owner of the patent rights No. RP 16642 and Copyrights Designs No. RD 13841 in and over Electronic Collapsible Transparent Ballot Boxes (ECTBB) and Patent Rights No. RP NG/P/2010/202-Proof of Address System/Scheme (PASS) (Embedded with the Concept of the Coded Metal Plate) and the process and application of these products respectively, to produce the voter’s register.
It is also asking for “a declaration that the plaintiff is entitled to 50 percent of the contract sum of ?39.6 billion for the production, supply, acquisition, importation, procurement, purchase, receipt, sale, of the direct data capt
