In a landmark ruling, Lawal Moshood has been sentenced to 14 years behind bars for the segxwal assault of a 78-year-old woman, whose identity remains undisclosed due to legal reasons. The victim has since passed away.
The verdict was delivered by Justice Rahman Oshodi of the Ikeja segxwal Offences and Domestic Violence Court on Friday, June 7, following Moshood's conviction on a one-count amended charge brought against him by the state for the rape of the elderly woman.
Initially pleading not guilty upon arraignment on May 13, by the prosecution led by Mr. B. E. Okeowo, Moshood later changed his plea to guilty on May 31, 2024, after an amended one-count charge was brought against him for an attempted segxwal assault by penetration, as per section 262 of the criminal law of Lagos State.
In delivering the judgement, Justice Oshodi recounted the harrowing details of the assault, stating, "The defendant encountered the survivor, a 78-year-old woman suffering from dementia, in Maryland on January 2, 2019. Exploiting her vulnerable state, he deceitfully offered assistance, only to subject her to a heinous act of segxwal abuse."
The court heard how Moshood lured the elderly woman to a secluded area where he perpetrated the assault, prompting intervention from concerned passersby upon hearing her cries for help.
Following the rescue, the victim was rushed to a police station where it was confirmed she had sustained injuries consistent with segxwal assault. Subsequent medical examination at Mirabel Medical Center corroborated the physical trauma she endured.
During the proceedings, when given an opportunity to address the court, Moshood expressed remorse, pleading for forgiveness. His counsel, Oyebanji Yusuf, similarly appealed for leniency, acknowledging the severity of the offense and emphasizing Moshood's regret.
Considering the plea bargain agreement reached between the prosecution and defense, Justice Oshodi handed down a 14-year prison sentence, starting from the date of Moshood's remand, January 2, 2019.
Despite the victim's passing, Justice Oshodi underscored the gravity of the crime, stressing the anguish inflicted upon a vulnerable elderly woman.
The convicted assailant was ordered to be returned to the Kirikiri Medium Custodial Center and his name enlisted in the Lagos State segxwal Offenders Register, serving as a deterrent against future offenses of a similar nature.
